Terms of Service

Effective Date: August 17, 2026

These Terms of Service ("Terms") govern your use of the MovePace mobile application, the MovePace website, and all related tools and content (collectively, the "Service"), operated by VC Design Lab, LLC ("Company," "we," "us," or "our"). By downloading, accessing, or using any part of MovePace, you agree to these Terms. If you do not agree to these Terms, you must not use the Service.

1. Eligibility

You must be at least 13 years old to use MovePace. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Service. The Service is not intended for children under 13.

2. Description of the Service

MovePace provides AI-generated coaching layered on top of running data you record with another app or device, including:

  • Reading run data from Apple Health (HealthKit) — distance, pace, duration, heart rate, and related metrics
  • Calculating personalized heart rate training zones
  • Generating Post-Run Summaries, Next Run Recommendations, Weekly Digests, and Recovery Status using artificial intelligence
  • Tracking training progress against a goal you select

MovePace is not a GPS run tracker and does not itself record workouts — you continue tracking runs with Apple Watch, Strava, Garmin, or any app that syncs to Apple Health. MovePace does not provide medical services or professional personal training services.

3. Health and Fitness Disclaimer

MovePace provides informational tools and AI-generated guidance related to running and training. The Service does not provide medical advice, diagnosis, or treatment, and is not a substitute for a physician's evaluation of your fitness to exercise. Any workout, run, or training performed using guidance from the Service is undertaken at your own risk.

Get Medical Clearance First If Any of the Following Apply to You. Before using MovePace or following any recommendation it generates, consult a physician if you: have been told by a doctor that you have a heart condition or high blood pressure; feel pain or pressure in your chest during physical activity or at rest; have lost your balance due to dizziness, or have ever lost consciousness; have a bone, joint, or connective tissue problem that could be made worse by increased physical activity; are currently taking medication for a heart condition or blood pressure; are pregnant; or know of any other reason you should not exercise without medical supervision. This list is adapted from standard pre-exercise medical screening and is not exhaustive — if you have any doubt about whether it is safe for you to exercise, or to follow a specific recommendation from MovePace, ask a physician before you do.

Stop Immediately If. Regardless of what MovePace has recommended, stop exercising immediately and seek emergency medical care (call 911 or your local emergency number) if you experience chest pain or pressure, unusual or severe shortness of breath, dizziness, lightheadedness, fainting, an irregular or racing heartbeat, or nausea. MovePace cannot detect these symptoms and does not monitor you in real time — recognizing and responding to them is entirely your responsibility. MovePace is not designed or intended for use in a medical emergency.

Coaching Recommendations. Any pace, distance, heart rate zone, effort level, or progression guidance provided through the Service is generated from the information you provide and your recorded workout history. These recommendations are statistical estimates, not an individualized medical assessment, and cannot account for every medical condition, medication, or physical limitation — including ones you have not disclosed or are not aware of. They are not a substitute for evaluation by a qualified physician or coach. You should reduce any recommended effort or stop entirely if you experience pain, dizziness, chest discomfort, or unusual difficulty. When in doubt, run easier than suggested or rest.

4. Assumption of Risk

Running and physical exercise involve inherent risks, including but not limited to:

  • Muscle, tendon, and ligament injuries
  • Joint injuries and overuse injuries
  • Cardiovascular complications, including heart attack, stroke, arrhythmia, and other cardiac or cardiovascular events
  • Injuries resulting from following pace, effort, or progression guidance provided by the Service
  • Serious bodily injury or death

Heart rate zones, pace, and effort recommendations generated by the Service are statistical estimates calculated from the information you provide and your recorded activity. They are not a medical safety guarantee, they are not individualized medical advice, and they cannot detect an undiagnosed heart condition or other medical risk factor — including one you were not aware of. You are solely responsible for monitoring your own body during exercise and for stopping immediately if you experience any of the warning signs described in Section 3, regardless of what the Service has recommended.

By using the Service, you acknowledge that you understand these risks and voluntarily assume all responsibility for any injury, loss, or damage that may occur as a result of your participation in physical activity or your use of any information provided by the Service. VC Design Lab, LLC shall not be responsible or liable for injuries, illness, or death resulting from your use of the Service, your reliance on its coaching recommendations, or your participation in exercise.

5. Apple Health Integration

MovePace integrates with Apple Health (HealthKit) to read workout, heart rate, and related data. This access is read-only — MovePace never writes to Apple Health. Use of Apple Health integration is controlled entirely by you through Apple's Health app permissions, and you may revoke it at any time. MovePace does not use Apple Health data for advertising or marketing purposes.

6. Artificial Intelligence Features

MovePace uses artificial intelligence systems to generate coaching insights, training recommendations, and progression suggestions based on your data. AI-generated outputs are informational and may not be accurate for every individual or situation. You remain solely responsible for determining whether any coaching recommendation is appropriate for your physical condition and experience level.

7. User Accounts

You access the Service using Sign in with Apple. You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms or misuse the Service.

8. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to systems or data
  • Reverse engineer, copy, or exploit the software
  • Misuse or abuse the Service in any way

9. Intellectual Property

All content, software, algorithms, designs, logos, and coaching systems associated with MovePace are the property of VC Design Lab, LLC or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial use. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Service without written permission.

10. Subscriptions and In-App Purchases

MovePace offers certain features through in-app purchases, which may include auto-renewing subscriptions. Where offered:

  • Payment is charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew for the same term unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price then in effect
  • You can manage or cancel your subscription at any time in your Apple ID account settings; canceling does not refund any unused portion of an active period
  • All payments, billing, refund requests, and free trial terms (where offered) are handled by Apple through the App Store, subject to Apple's own terms and policies
  • Pricing may change with notice as required by applicable law and App Store guidelines

11. Disclaimer of Warranties

The Service is provided "as is" and "as available." To the fullest extent permitted by law, VC Design Lab, LLC disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee that the Service will always be available, secure, or free of defects.

12. Limitation of Liability

To the maximum extent permitted by law, VC Design Lab, LLC shall not be liable for:

  • Personal injury
  • Injuries resulting from use of pace, effort, heart rate zone, or progression guidance provided by the Service
  • Indirect, incidental, or consequential damages
  • Loss of profits or loss of data
  • Service interruptions

Our total liability arising from the use of the Service shall not exceed the greater of $100 USD or the total amount paid by you to the Company in the preceding 12 months.

13. Indemnification

You agree to indemnify and hold harmless VC Design Lab, LLC and its affiliates from any claims, damages, liabilities, or expenses arising out of your use of the Service, your violation of these Terms, your participation in physical exercise or training, or your reliance on coaching recommendations or informational content provided by the Service.

14. Termination

We reserve the right to suspend or terminate access to the Service at any time if you violate these Terms. You may stop using the Service at any time.

15. Arbitration and Dispute Resolution

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration. Arbitration shall take place in the State of Delaware, unless otherwise required by law. You agree not to participate in class actions or collective proceedings.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

17. Severability

If any provision of these Terms is found by a court or arbitrator to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect. The remaining provisions, including the rest of Sections 4 (Assumption of Risk) and 12 (Limitation of Liability), continue to apply even if one part of either section is held unenforceable.

18. Changes to These Terms

We may update these Terms from time to time. If changes occur, the Effective Date will be updated. Continued use of the Service after updates constitutes acceptance of the revised Terms.
